2. Eligibility & Account

  • You must be at least 18 years of age to make a purchase on this website.

  • Users are responsible for maintaining the confidentiality of their account and password.

  • Duarte Fish Farm reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

3. Product Accuracy & Pricing

  • We strive to display the colors and details of our Bettas, Guppies, and plants as accurately as possible.

  • Please note that since these are living organisms, slight variations in color and pattern are natural and expected.

  • All prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price.

4. Livestock & Shipping Liability

  • Livestock Risk: Once a fish or plant is successfully delivered and acclimated to your aquarium, the responsibility for its health transfers to the buyer.

  • Shipping Address: The customer is responsible for providing a correct and complete shipping address. Duarte Fish Farm is not liable for losses caused by address errors or packages left unattended in extreme weather.

  • Carrier Delays: While we use reliable carriers, we are not responsible for delays caused by the shipping company, though we will assist in filing claims where applicable.

5. Intellectual Property

  • All content on this site, including logos, images generated for the brand, and text, is the property of Duarte Fish Farm or its content suppliers and is protected by international copyright laws.

  • The use of our logo or any visual assets without express written consent is strictly prohibited.

6. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Florida, and you irrevocably submit to the exclusive jurisdiction of the courts in that State.

8. Order Cancellation

Orders may only be canceled before they have been packed for shipment. Once an order has been prepared, packed, or transferred to the carrier, cancellations, modifications, or refunds will not be permitted.

By placing an order with Duarte Fish Farm, customers acknowledge that they have read, understood, and agreed to the Store Policy, Live Arrival Guarantee (DOA), Return Policy, Privacy Policy, and Terms & Conditions.
